Definitions

1.1 Course Brochure: Refers to the current version of the Pink Elephant EMEA training and education brochure, detailing the content of Pink Elephant EMEA courses.

1.2 Course(s): Training and education programmes offered by Pink Elephant EMEA and its partners.

1.3 Course Fees: The fees listed in the Pink Elephant EMEA course brochure.

1.4 Public Courses: Scheduled courses taught by one or more instructors at a location determined by Pink Elephant EMEA.

1.5 Customer: Any individual or organisation purchasing services from Pink Elephant EMEA.

1.6 Course Venue: The location where Pink Elephant EMEA presents its courses.

1.7 Course Documentation: Handouts and materials issued to each student during a course.

1.8 Student: A person nominated to attend a Pink Elephant EMEA course.

1.9 Pre-Requisites: Specific requirements that must be met prior to course attendance, as specified in the course details.

2.0 Third-Party Bookings: Courses advertised through third-party resellers, subject to additional terms and conditions.

Fees

2.1 Public Course Fees: These include coffee on arrival, morning and afternoon refreshments, one copy of course documentation per delegate (where applicable), and writing materials. Accommodation is not included.

2.2 VAT: Payable at the prevailing rate for all courses held in the UK, irrespective of the delegate’s nationality. VAT may be reclaimed locally in any EEC member country.

2.3 Fee Changes: Pink Elephant EMEA reserves the right to adjust course fees at any time. Bookings confirmed prior to a fee increase will be honoured at the original fee.

2.4 Examination Fees: These may change without prior notice. Pink Elephant EMEA reserves the right to pass any increase in examination fees on to the customer.

2.5 Credit Card Payment Fees: Some credit cards may incur additional charges. Current details of these charges can be found on the booking form.

2.6 Discount Policy: Special offers on course fees made by Pink Elephant EMEA cannot be combined with the standard discount policy, where applicable.

2.7 ‘Packaged’ Fees: When courses are offered as a ‘Package’, the entire package must be booked at the same time. Any deviation from the package voids the discounted fee, and standard fees will apply.

Payment

3.1 Upon booking confirmation, a VAT invoice will be sent to Accounts Payable unless otherwise specified.

3.2 Condition of Booking: Payment must be received prior to course attendance. Your place is not confirmed until payment is received.

Cancellations and Rescheduling of Public Scheduled Courses

4.1 Cancellation Charges: No cancellation charges will apply if notice of cancellation is received more than 15 working days before the course start date. If cancellation occurs less than 15 working days before the start date, the full course fee will be charged. Postponement or transfer to another date is treated as a cancellation and will follow the same terms.

4.2 Rescheduling: You may reschedule your course once without incurring additional charges.

Third-Party Bookings

5.1 Cancellation Policy: For bookings made through third-party suppliers or resellers of Pink Elephant training courses, you may cancel your course within 14 calendar days from the date of purchase. This is your “Cancellation Period”. However, if you redeem your exam voucher or log in to your e-learning course during this period, you forfeit your right to cancel and obtain a refund.

5.2 Cancellation Process: To cancel a course booked through a third-party, contact us at info@pinkelephant.co.uk or +44 (0) 118 324 0620, providing all necessary booking information.

5.3 If you cancel within the 14-day period, a refund will be issued within 14 calendar days from the date your cancellation is accepted.

Non-Attendance & Substitutions

6.1 Non-Attendance: If a delegate does not attend a booked or transferred course, the full advertised course fee will be charged.

6.2 Substitutions: You may substitute a delegate with another employee from the same organisation at any time without incurring charges, provided we are notified before the course start date.

Course Changes

7.1 Pink Elephant EMEA reserves the right to alter any part of the published course programme, including date, presenter(s), venue, and content if necessitated by circumstances beyond their control. Best efforts will be made to keep changes to a minimum. Pink Elephant EMEA shall not be liable for any costs incurred due to such changes.

Documentation

8.1 The copyright of all course documentation (including workbooks, handouts, and exercises) belongs exclusively to Pink Elephant EMEA or the licensor as indicated in the material. Documentation may not be copied, summarised, or reproduced by any means without written consent from the copyright owner. Legal action may be taken against those who misuse or illegally distribute materials.

Use of Information by Students

9.1 Pink Elephant EMEA makes every effort to ensure the accuracy of information provided during a course. However, we accept no liability for any claims relating to loss of business or consequential damage incurred by a customer as a result of a student using information from a Pink Elephant EMEA course. All information is provided with the understanding that it is subject to the standards, procedures, and practices in operation at the student’s place of work.

Law

10.1 The contract between Pink Elephant EMEA Ltd. and its customers shall be governed by English law.

Force Majeure

11.1 Neither party shall be responsible for failure to fulfil its obligations hereunder if such failure results from any cause beyond its reasonable control.
